Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period during which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Continuous transaction: A distance contract for a series of products/services, with delivery/purchase obligations spread over time.
  • Durable data carrier: A means that enables information to be stored and retrieved unchanged for future reference.
  • Right of withdrawal: The consumer's option to withdraw from a distance contract during the cooling-off period.
  • Entrepreneur: The person or business offering products/services to consumers remotely.
  • Distance contract: An agreement concluded using one or more means of remote communication, organized by the entrepreneur.
  • Means of remote communication: Tools enabling contract formation without the need for simultaneous physical presence.
  • General Terms and Conditions: These current terms and conditions of the entrepreneur.

Article 3 – Applicability

  • These general terms apply to all offers, distance contracts, and orders between the entrepreneur and consumer.
  • Before the contract is concluded, the terms will be made available. If not reasonably possible, the consumer will be informed where to access them and that they can be sent free of charge upon request.
  • For electronic contracts, the terms will be supplied in a format that can be stored on a durable data carrier.
  • In case of specific product/service conditions in addition to these terms, the most favorable condition for the consumer will apply in case of conflict.
  • If any clause is found invalid or void, the remainder stays in effect and a replacement provision applies.
  • Situations not covered or ambiguities will be interpreted in the spirit of these terms.

Article 4 – The Offer

  • If the offer has a limited validity period or special conditions, it will be clearly stated.
  • The offer is non-binding and may be modified by the entrepreneur.
  • The description of products/services will be accurate and detailed.
  • Images and specifications are indicative; no rights can be derived from them.
  • Prices do not include import VAT and clearance fees—these are payable by the customer.
  • The offer includes sufficient information for the consumer to understand their rights and obligations, such as:
    • Price (excluding additional import charges)
    • Shipping costs
    • Conclusion and steps of the agreement
    • Whether the right of withdrawal applies
    • Payment, delivery, and execution details
    • Validity of the offer
    • Tariffs for remote communication (if applicable)
    • Storage and access to the agreement
    • Data verification and correction methods
    • Available contract languages
    • Applicable codes of conduct
    • Duration of the contract for continuous transactions
    • Optional product details like sizes, colors, materials

Article 5 – The Agreement

  • The contract is concluded once the consumer accepts the offer and meets the set conditions.
  • For electronic acceptance, confirmation will be sent by the entrepreneur. The consumer may cancel until receipt is confirmed.
  • The entrepreneur will secure electronic data transfer and provide a safe payment environment.
  • Before accepting the contract, the entrepreneur may investigate the consumer’s ability to meet obligations. Based on this, they may refuse or impose special conditions.
  • After conclusion, the entrepreneur will provide the consumer with the following (in writing or storable format):
    • Business address for complaints
    • Information on withdrawal rights or exceptions
    • Warranty and after-sales details
    • The Article 4 data, unless already provided
    • Termination conditions for contracts of more than one year or indefinite duration
  • For continuous transactions, this information is only provided with the first delivery.
  • All agreements are subject to product availability.
